Rules and Procedures for the Committee and the Parties to the Complaint 1) The members of the Investigating Committee will elect a Chairperson at the first meeting. 2) The Investigating Committee will clarify, to its satisfaction, the nature of the complaint. 3) Prior to commencement of proceedings by the Investigating Committee, the person(s) making the complaint and the person(s) complained against shall: a) agree that the proceedings shall take place without recourse to legal counsel; b) agree that all evidence adduced and submissions made before the Committee . shall be treated as privileged and confidential; : c) attempt to prepare an agreed state- ment of facts and issues for the purpose of the proceedings, and the President may appoint an individual who is not a member of the Investigating Committee to assist the parties in preparing this statement. 4) The person(s) making the complaint and the person(s) -com- plained against will identify, in writing, those issues, occurrences and sequence of events they wish to refer to in order to substantiate or refute the complaint. In so doing, each party will identify the evidence including witnesses and documents in support of their respective positions. 5) The Committee will hear the evidence. As the investigation proceeds, the Committee may identify any additional evidence it wishes to receive and endeavour to have it produced in the presence of the parties to the complaint. 6) The Committee will consider all the evidence before it and write and submit its report with recommendations.
